These terms cover your use of this website. They are written in plain English. The short version is that this site is here to describe what Miller Utilities does, and that any actual work between us is governed by a signed contract and the bid documents for that project, not by this website.
1.About this site
This website is published by Miller Utilities, 2911 Enterprise Ave, Suite B, Hastings, MN 55033. It exists to describe our capabilities, our service area, and the kind of work we take on, so that a prospective owner or contractor can decide whether to invite us to bid.
We provide the site as-is. We work to keep it accurate and current, but we do not warrant that every detail is complete, error free, or continuously available.
2.Nothing on this site is an offer or a bid
This is the most important term on the page. The capability descriptions, project descriptions, footage and diameter figures, schedules, service-area statements, and any other specifics on this site are informational. They describe work we have done or work we are equipped to do. They are not an offer, not a quote, not a bid, and not a commitment to perform.
All work is governed by a written contract and the bid documents issued for that specific project. Scope, pricing, schedule, means and methods, exclusions, and every other term are established in those documents. Where anything on this website conflicts with an executed contract or bid document, the contract and bid documents control.
Do not rely on this website when estimating, scheduling, or specifying a project. Send us the scope and we will respond with an actual number.
3.Capability and project descriptions
Descriptions of past projects are summaries. They are not a representation that we will achieve the same result, production rate, or schedule on your project. Ground conditions, utility congestion, permitting, restoration standards, and weather differ on every job and are the reason two similar-sounding bores are not the same work.
4.Intellectual property
The content on this site, including text, photographs, graphics, logos, and the Miller Utilities name and marks, belongs to Miller Utilities or to the parties who licensed it to us. It is protected by copyright and trademark law.
You may view this site, and print or download pages for your own internal use in evaluating us for a project. You may not republish, resell, or use our content or marks commercially, or present our work as your own, without our written permission.
5.Links to other sites
This site may link to websites we do not operate, including other Miller family companies, suppliers, agencies, and industry resources. We provide those links for convenience.
We do not control those sites and are not responsible for their content, their accuracy, or how they handle your information. Their terms and privacy policies apply when you are on them, not ours.
6.Limitation of liability
To the fullest extent allowed by law, Miller Utilities is not liable for indirect, incidental, special, or consequential damages arising out of your use of this website, or out of reliance on information published on it. That includes lost profits, project delay costs, and re-bid costs.
This limitation is about the website. It does not limit, waive, or modify any obligation we take on under a signed construction contract, and it does not apply where the law does not allow it to.
7.Your use of this site
Use this site lawfully. Do not attempt to interfere with it, gain unauthorized access to it, scrape it in a way that degrades it for others, or submit false information or another person's details through our forms.
8.Governing law
These terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules. Any dispute arising out of this website will be brought in the state or federal courts located in Minnesota.
Governing law and venue for an actual construction project are set by that project's contract, which may differ from this and which controls for that work.
9.Changes to these terms
We may update these terms. When we do, we will change the effective date at the top of this page. Continuing to use the site after that means you accept the updated terms.
